General Terms and Conditions of Stade Auktionen

1. Prices, payment methods, shipping method

The purchase price is due immediately upon conclusion of the contract. Subject to the following provisions, payment shall be made in advance or by invoice. Furthermore, deliveries are only made to traceable order addresses. In individual cases, we reserve the right to deliver only after receipt of payment (advance payment). The claim is only fulfilled when the amount has been credited to Stade Auktionen’s account. The claim must be settled within 4 weeks of receipt of the invoice.

2. Data exchange with credit agencies

Stade Auctions is entitled to transmit personal contract data as well as information on non-contractual processing (e.g. termination due to default of payment, applied for default summons in the case of undisputed claims as well as enforcement measures) to the German credit bureau SCHUFA (Schutzgemeinschaft für Allgemeine Kreditsicherung) and to obtain corresponding information there in order to protect against bad debts and the risk of improper use of the services by third parties. Insofar as such data is collected by SCHUFA from other customer relationships during the customer relationship, Stade Auktionen will receive information about this. Any such data transfer only takes place insofar as this is necessary to safeguard the legitimate interests of Stade Auktionen, a contractual partner of SCHUFA, and the customer’s interests worthy of protection shall not be impaired.

3. Unconstitutional and propagandistic symbols

As long as website visitors do not state otherwise, you assure that you are acquiring the images and the symbols contained therein as well as objects from the period of the Third Reich only for the purposes of civic education, the defense against unconstitutional and anti-constitutional efforts, scientific and art-historical research, education or reporting on current events or military-historical and uniform research (§ 86a of the German Penal Code [StGB]). If there is a reasonable suspicion that a buyer is considering unconstitutional intentions with the purchase, Stade Auktionen will cancel the sale in accordance with §2 of the General Terms and Conditions and inform the public prosecutor’s office.

4. Packaging Ordinance

Packaging Ordinance: In accordance with the provisions of the German Packaging Ordinance, we are obliged to take back packaging for our products that does not bear the mark of a nationwide disposal system (such as the “Green Dot” of Duales System Deutschland AG or the “RESY” symbol) and to ensure that it is reused or disposed of. Please contact us for further clarification regarding the return of such products. We will then inform you of a municipal collection point or a disposal company in your area that will accept the packaging free of charge. If this is not possible, you have the option of sending the packaging to us. The packaging will be reused by us or disposed of in accordance with the provisions of the Packaging Ordinance.

5. Cancellation policy

You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods.
To exercise the right to cancel, you must inform us (Stade Auktionen GmbH & Co. KG, Markgrafenstraße 5, 79639 Grenzach-Wyhlen E-mail: info@stade-auktionen.de Tel: +49 7624 9895870) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You can use the attached sample withdrawal form, but this is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment.
You must return or hand over the goods to us immediately and in any case within fourteen days at the latest from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.
You bear the direct costs of returning the goods.
You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties and functionality.

6. Place of jurisdiction, applicable law

In commercial transactions, the place of performance for the mutual obligations shall be the registered office of Stade Auktionen and the place of jurisdiction for both parties shall be Lörrach. German law shall apply exclusively to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

7. Contract language

The contract language is German.
